COURSE CONTRIBUTION TO PROGRAM

The objective of this course is to achieve a basic language related to the main types of intellectual property, and the main aspects of its protection (rationale, purpose, subject-matter and scope of protection, duration and limits) in order to be able to maximize its value for the business purposes.

Course Learning Objectives

Upon completing this course, students have to be able to legally and critically analyse typical intellectual property business management issues and resolve them.

Specifically, The course aims to deepen about:

1 - What is intellectual property and what value brings to the business;

2 - What types of intellectual property exist: identification of the most relevant intellectual property rights for the different sectors (mainly patents, know-how, designs, trademarks and intellectual property rights in the strict sense);

3 - Main issues of due diligence of each type of intellectual property;

4 - Maximization of intangible assets:

a. Why protecting intellectual property?

b. Where securing IP Rights (territorial strategy)?

c. How to protect intellectual property rights (main substantive requirements)?

d. Main issues in licensing / transferring of intellectual property

CONTENT

1. Session 1: Introduction to Intellectual Property. Overview and main kinds of IP rights. What value may IP bring to my business?

2. Session 2: Trademarks. 1st Hypothetical: How to protect my brand in a globalized word?

3. Session 3: Patents. 2nd Hypothetical: Should we patent it or keeping it as know-how?

4. Session 4: Designs. Presentation in groups.

5. Session 5: Final Exam. Review.

Methodology

The sessions will be developed mainly from the resolution of written hypothetical cases previously analysed by the student. These cases will be published on the website of the course with at least 5 days in advance.

Assessment criteria

- 10 minute group presentation in the 4rth Session: 25%

- Individual resolution of a case study during the last session (multiple choice) -- 75%
