Prerequisites

Students need to have successfully passed Labour Law I

Previous Knowledge

Have knowledge regarding the Labour Law concept, the related sources of law and the principles behind the application and interpretation of labour norms, as well as the concepts of workers and businesspeople, the different types of job contracts and the legal norms governing their modification.

COURSE CONTRIBUTION TO PROGRAM

Upon successfully completing this subject, students will have a solid background in Labour Law at the dynamic and collective levels. By mastering the latter, students will gain the training needed to advise companies on the possibilities of suspending or terminating job contracts and outsourcing, advise workers on their rights, hold labour union elections within the company, negotiate and interpret collective bargaining agreements, and make legal determinations regarding any of the topics studied in class, including the proceedings required to start a strike and the scope of the right to work and its limits, etc.

Course Learning Objectives

The aim of this subject is to introduce students to the legal framework governing labour relations at the dynamic and collective levels. Consequently, the subject studies the vicissitudes of labour relations (job contract suspension and termination), the labour-related consequences of different types of business arrangements and what we could call Collective Labour Law, examining norms governing worker representation and businesspeople, collective bargaining and strikes.

Methodology

Assessment criteria

Assessment for this subject includes three components:

1. Theoretical exam (50%), a written exam comprising four specific questions on the theoretical/practical content to be answered without consulting any material in a limited space and with limited time. Students have to earn a minimum of 4 out of 10 to be able to average this mark with the ongoing assessment mark.

2. Practical exam (20%), a written exam consisting of a practical case study and a series of questions to be answered. Students may consult basic legislation (printed format). Students are required to provide technically correct and well-reasoned answers. Students have to earn a minimum of 4 out of 10 to be able to average this mark with the ongoing assessment mark.

3. Ongoing assessment (30%), consisting of case study analyses, presentation of oral exercises and class participation. Specifically, it includes the ongoing assessment of students¿ theoretical knowledge and their ability to apply it: a) ongoing assessment of students¿ ability to learn on their own, their ability to analyse, summarise and orally present practical case studies in class; and b) ongoing assessment of their practical knowledge: correctly applying the legal norms and both oral and written reasoning, the search for doctrine and jurisprudence and its application in concrete cases. Attendance is also compulsory to be able to pass this subject as is handing in all assignments on time and carrying out the oral presentations requested by faculty. 10% of the ongoing assessment component corresponds to the Interdisciplinary Legal Exercise (EJI in Spanish).

If students have to re-sit the final exam, the final mark for the subject will consist of the theoretical exam (50%) + practical exam (50%).

Students who do not:
1. Pass the subject at the FIRST EXAM SITTING because they have not passed the ongoing assessment component, will not be allowed to RE-SIT the final. Instead, they will have to retake the subject and complete all the activities, focusing, in particular, on class participation.

2. Obtain the required level of skills will be able to sign up for the next course as long as they have passed the corresponding exam(s). However, they will not be able to complete their final degree project without first attaining the level of skills required as part of the Bachelor degree programme.
