COURSE CONTRIBUTION TO PROGRAM

With the Civil Law IV subject, students will acquire a general view of Civil Law as part of the Bachelor in Law (GED) programme. It represents the last step in all legal professionals¿ initial training, given that: 1) as legal professionals, their learning never ends; and 2) thus far, they have only explored Law in a ¿lab¿ environment, transitioning now to experiencing it as a social reality. After completing the Civil Law III course, students will have explored a good part of this specialisation and, concretely, the major institutions related to economic questions. However, to complete this first stage in their learning process, they need to explore Family and Inheritance Law. Thus, in this subject, students will consolidate the concepts, frameworks and methods learnt in the compulsory Civil Law subjects and combine them with all those related to family relations and the legal consequences resulting from the demise of a physical person. This makes Family Law an interesting means to carry out tests in this area, examining how all the independent pieces of Civil Law interact.

Learning objectives

The specific objectives for this subject are for students to:
1. Acquire a global vision and understanding not only of the subject¿s specific content but also consolidate the Civil Law content studied in previous subjects.
2. Master how to read, understand and apply legal texts and sources.
3. Habitually use the appropriate techniques to interpret legal texts.
4. Consolidate their instrumentalist and utilitarian view of Law, in particular, Civil Law as a social engineering instrument and as an area that¿s permeable to cultural and traditional questions.

CONTENT

1. FAMILY LAW

Unit I: Families and Family Law
Unit 2: Marriage. Marriage and its celebration. Effects of marriage. Marriage¿s annulment, relaxation and dissolution. Common regime governing marriage annulment, separation and divorce.
Unit 3: Asset regime in marriages. Marital property agreements. Matrimonial benefits (¿avantages matrimoniaux¿). Matrimonial property regime.
Unit 4: Non-marital families.
Unit 5: Filiation. Matrimonial filiation. Extra-marital filiation. Adoption.
Unit 6: Parental and quasi-familiar relations. Guardianship. Kindred relationships. Maintenance claims between family members. Guardian institutions.
