COURSE CONTRIBUTION TO PROGRAM
The objective of this course is to achieve a basic language related to the main types of intellectual property, and the main aspects of its protection (rationale, purpose, subject-matter and scope of protection, duration and limits) in order to be able to maximize its value for the business purposes.
Course Learning Objectives
Upon completing this course, students have to be able to critically analyse typical intellectual property business management issues and resolve them.
Specifically, The course aims to deepen about:
1 - Identification of the most relevant intellectual property rights involved in a specific Business or new venture (patents, know-how, industrial designs, trademarks and copyrights);
2 - Understand the main issues of due diligence of each type of intellectual property that any entrepreneur should be aware of.
3 - Understand possible strategies to maximize the value of the intangible assets involved in a specific Business or new venture.
4 - Understand basic issues involved in transferring/licensing IP Rights.
CONTENT
1. Introduction to Intellectual Property Overview and main kinds of IP rights. What value may IP bring to my business? Coexistence of IP Rights. Industrial Designs |
2. Patents v. Trade secrets |
3. Inventions Patent law basics. Rationale. Substantive requirements. Types of Patents. Territorial Strategy. In group hypothetical resolution |
4. IP Licensing Basic aspects in IP Licensing. In class negotiation |
5. Brand Protection What brand to choose? How and where to protect a trademark? Territorial strategy. In group hypothetical resolution |
Methodology
The sessions will have a first part where the teacher will explain the basics. A second part where the students will have to solve (in groups) a hypothetical case based on the previous explanation by the teacher. In the final part of the class the hypothetical will be solved and discussed with the whole group.
Assessment criteria
1) In class resolution (in groups) of 3 hypothetical cases: 75 % of the final grade (25% each).
2) In class negotiation (in groups) of an IP Deal: 25 % of the final grade
